The Aletheia Talent Group: Event Terms of Service and Privacy Notice

Last updated: October 26th, 2026

PLEASE READ CAREFULLY. SECTION 5 GRANTS BROAD RIGHTS TO USE YOUR NAME, IMAGE AND LIKENESS. SECTION 13 REQUIRES INDIVIDUAL ARBITRATION AND WAIVES CLASS ACTIONS.

1. Agreement and who it covers. These Terms are a binding agreement between you and The Aletheia Talent Group, LLC, a New York limited liability company, together with its parents, subsidiaries, affiliates, joint ventures, operating brands and divisions, and each of their successors, assigns, licensees, officers, members, managers, employees, contractors and agents (together, “ATG,” “we” or “us”). They apply to every website, event page, RSVP, guest list, reservation, mailing list, text list, message, social media account and event that ATG hosts, produces, promotes, manages or appears at, under any name or brand (together, the “Services”). You accept these Terms by ticking a box or tapping a button that refers to them, by confirming a reservation or guest list spot that refers to them, by joining any of our lists, or by entering an event where they are posted. If you do not agree, do not use the Services or enter our events.

2. Definitions. “Recordings” means all photographs, video, audio, livestreams, film and other recordings or captures, in any format, made by or for ATG at or in connection with any event or Service. “Likeness” means your name, nickname, image, photograph, appearance, face, body, physical characteristics, voice, statements, gestures, performance, biographical information and social media handle, and any depiction or simulation of any of them, including depictions that are edited, retouched, cropped, composited, enhanced, animated, or generated or modified using artificial intelligence or other software, in each case to the extent derived from Recordings or from material you provide or post. “Affiliates” means everyone included in “ATG” above, plus the venues, promoters, ticketing companies, sponsors, media partners and production partners ATG works with on an event.

3. Eligibility. Our events and lists are for people 21 and older. By using the Services you confirm you are at least 21 and legally able to enter into these Terms. Venues check ID and their decision is final.

4. Events, venues and tickets. Most events take place at venues ATG does not own or operate. Tickets may be sold by third-party ticketing companies under their own terms, which govern refunds, transfers and chargebacks. Venues set and enforce their own dress codes, prop, bag, capacity and conduct rules, and may refuse entry to or remove anyone. Talent, times, themes, pricing and availability may change or be cancelled without notice. An RSVP, guest list spot or table request is not a ticket and does not guarantee entry unless ATG confirms otherwise in writing.

5. Grant of rights in your name, image and likeness.

(a) Consent to be recorded. You acknowledge that our events are photographed, filmed, recorded and livestreamed, and you consent to being recorded.

(b) License. You irrevocably grant ATG and its Affiliates a worldwide, perpetual, royalty-free, fully paid, transferable and sublicensable license to record, use, reproduce, edit, alter, retouch, crop, composite, enhance, animate, generate derivative works from, publish, display, perform, broadcast, stream, distribute and otherwise exploit your Likeness and the Recordings, in whole or in part, alone or with other material, in any and all media and formats now known or later developed, for any lawful purpose, including advertising, trade, marketing, promotion, publicity, sponsorship, merchandising, social media, editorial, documentary and archival purposes, and including the promotion of ATG, its Affiliates, their brands, events, talent, venues and partners.

(c) Written consent. Ticking a box, tapping a button or confirming a reservation that refers to these Terms is your written consent and electronic signature under New York Civil Rights Law sections 50 and 51, the New York Electronic Signatures and Records Act and the federal E-SIGN Act, and under any similar law anywhere.

(d) Ownership. ATG and its Affiliates own all rights, including copyright, in the Recordings. You have no ownership or other interest in them.

(e) No payment, no approval. Your admission, access and participation are full consideration for this grant. You are not entitled to payment, royalties, credit or any other compensation, and you waive any right to inspect or approve any Recording, use, copy or depiction before it is used.

(f) Release. To the fullest extent the law allows, you release and agree not to sue ATG and its Affiliates over any claim arising from a use permitted by this Section, including claims for invasion of privacy, misappropriation, violation of the right of publicity, false light, and claims based on editing, alteration, distortion or digital or AI modification, and you waive any moral rights.

(g) Requests. If you do not want to be featured, tell a member of our team at the event or email [email protected]. We will consider reasonable requests about future uses at our discretion. Granting a request does not revoke this license or require us to remove anything already published.

(h) Survival. This Section survives the end of your use of the Services and any unsubscribe or opt-out.

6. Content you send or post. If you send us, post, tag or mention our accounts or events in any photo, video, audio, text, review or other content, you grant ATG and its Affiliates the same license as in Section 5(b) in that content and in your Likeness as it appears there, and you confirm you have the right to grant it, including the consent of anyone else shown.

7. Emails and texts. By joining any list or RSVPing, you agree that ATG and its Affiliates may email you about events, talent, offers and related news. Every marketing email includes an unsubscribe link. We send marketing texts only if you separately agree to receive them. If you do, you authorize ATG and its Affiliates, including the brand named where you agreed, to send recurring marketing texts, including texts sent with automated technology, to the number you provided. Consent to texts is not a condition of any purchase or of entry. Message frequency varies. Message and data rates may apply. Reply STOP to cancel and HELP for help. Carriers are not liable for delayed or undelivered messages.

8. Your conduct and assumption of risk. Nightlife events involve crowds, loud music, strobe and low lighting, haze, alcohol and late hours. You attend voluntarily and at your own risk, you are responsible for your own conduct, drinking, health and belongings, and you will follow venue staff and the law. To the fullest extent the law allows, you release ATG and its Affiliates from claims for injury, illness, loss or damage arising from attending an event, except to the extent caused by our gross negligence or willful misconduct.

9. Our content. ATG’s names, logos, Recordings, designs and text belong to ATG or its licensors. You may share our public posts using the platform’s own share tools. Any other commercial use requires our written permission.

10. Disclaimers. THE SERVICES AND EVENTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” ATG MAKES NO WARRANTIES ABOUT ANY VENUE, TICKETING COMPANY, PERFORMER, GUEST OR EVENT, TO THE FULLEST EXTENT THE LAW ALLOWS.

11. Limitation of liability. TO THE FULLEST EXTENT THE LAW ALLOWS, ATG AND ITS AFFILIATES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, AND THEIR TOTAL LIABILITY TO YOU FOR ALL CLAIMS IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID DIRECTLY TO ATG IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

12. Indemnity. You will defend, indemnify and hold harmless ATG and its Affiliates from claims, losses and costs, including reasonable attorneys’ fees, arising from your conduct at any event, content you provide, or your breach of these Terms.

13. Disputes: individual arbitration and class action waiver.

  • Informal resolution first. Before starting any proceeding, the party with a claim will send written notice describing it, and the parties will try in good faith to resolve it for 30 days. Notices to ATG go to [email protected].
  • Binding arbitration. Any dispute, claim or controversy arising from or relating to these Terms, the Services, any event, any Recording or use of your Likeness, or any email or text message, will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in New York County, New York, or by video conference. The Federal Arbitration Act governs this Section. The arbitrator decides all questions of arbitrability, except that only a court may decide the enforceability of the class action waiver below.
  • Small claims. Either party may bring an individual claim in small claims court instead.
  • No class or representative actions. You and ATG may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. If this waiver is found unenforceable as to any claim, that claim will proceed in court and not in arbitration.
  • Mass filings. If 25 or more similar demands are filed by or with the help of the same law firm or coordinated counsel, they will be administered in batches of no more than 25, with remaining demands, and any filing fees for them, held until each earlier batch is resolved.
  • Time limit. Any claim must be brought within one year after it arises, to the extent the law allows.
  • Opt out. You may opt out of this Section 13 by emailing [email protected] within 30 days after you first accept these Terms, with your name, the email or phone you used, and the subject line “Arbitration Opt-Out.” Opting out does not affect any other part of these Terms.

14. Governing law and venue. New York law governs these Terms, without regard to conflict-of-law rules. Any matter not subject to arbitration will be heard only in the state or federal courts located in New York County, New York, and you consent to their jurisdiction.

15. Privacy Notice.

  • What we collect. What you give us: name, email, phone, social media handle, company, job title, party size and anything you send us. Event records: RSVPs, check-ins, tickets bought through our links and tables booked. How you interact with our emails, texts and pages: opens, clicks, device and browser. Purchase and attendance records that venues and ticketing partners share with us.
  • How we use it. To run guest lists and reservations, send event emails and, if you agreed, texts, understand which events and messages people respond to, keep our lists accurate, prevent fraud and meet legal obligations.
  • Who we share it with. Our Affiliates. Venues and ticketing partners for events you attend or book. Service providers that run our email, text, CRM, website and analytics tools. Advertising platforms such as Meta, which receive hashed email addresses or phone numbers so we can show our events to past guests, exclude people from ads, or reach similar audiences. Authorities where the law requires. Some of this sharing, including with advertising platforms, may be considered a “sale” or “sharing” of personal information under certain state privacy laws. Our Privacy Policy at aletheiatalent.group/privacy describes these practices and your rights in full, and controls if it conflicts with this Section.
  • Your choices. Unsubscribe from any email using its link. Reply STOP to any text. Email [email protected] to access, correct or delete your information, or to opt out of advertising-platform matching. We respond within 30 days and may keep a minimal record of an opt-out so we do not contact you again.
  • Retention. While you are on our lists and for up to three years after your last interaction, unless the law requires longer.
  • Security. We use reasonable safeguards. No system is perfectly secure.
  • Age. We do not knowingly collect information from anyone under 21 and delete it if we learn we have.

16. Changes. We may update these Terms by posting a new version with a new date. Changes apply from the date posted. Your continued use of the Services, or a new RSVP, reservation or entry, after a change means you accept it. Changes to Section 13 do not apply to a dispute already noticed.

17. General. If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the rest of these Terms stays in force. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms. ATG may assign them, in whole or in part, to any Affiliate or successor. These Terms are the entire agreement between you and ATG about their subject.
